Review of Existing Private Sewers and Drains in England and Wales

The House Builders Federation's response to the DEFRA consultation

Our view is that the existing legislation is generally adequate but enforcement is patchy and generally parties are not aware of their responsibilities.

Introducing legislation to enable existing lateral drains to be adopted could be difficult but it would be advantageous if this could apply to new developments.

It would be helpful to issue guidance notes to help resolve disputes over adoption and to publish guidelines for Building Control officers and householders.

New adoption guidelines and procedures for existing private sewers would also be an advantage.

It would also be beneficial if insurers could explain more clearly what their policies cover and possibly offer greater cover than they do at present.
